Creditors’ Rights

Our attorneys represent business and individual creditors, to help them attempt to recover debt.   This includes litigation to obtain judgments, utilizing proprietary tools and the court system to collect judgments, and navigating bankruptcy cases to try to protect our clients’ interests.

Our experience with creditors’ rights includes garnishment, replevin, forcible detainer, property foreclosure, lien foreclosure, receivership, deficiency litigation, automobile deficiencies, and fraudulent transfer litigation.  We have litigated all aspects of creditor claims, from small justice court trials to representing creditors in the court of appeals.

Our most common creditors’ rights matters include:

Collection. Once a judgment is obtained, a creditor must find assets and take the necessary steps to recover.  We use cutting edge research tools and a proprietary asset search to locate assets that can be recovered.

Judgment Domestication.  When a creditor obtains a judgment outside of Arizona, and wants to collect against a debtor or assets located in Arizona, we help that creditor domesticate the judgment in Arizona.

Bankruptcy. When a debtor files for bankruptcy, creditors can lose their right to recover if they fail to protect themselves. Our firm is experienced representing creditors in bankruptcy matters, including proofs of claim, motions for relief from the automatic stay, defending liens, and preference litigation.
